The Petitioner challenges the show-cause notice dated 21.11.2016 issued to him by the Maharashtra Industrial Development Corporation. Para Nos. 7 and 8 of the show - notice reads as under :

"7. In case you desire to be heard, you may call on the undersigned on any working day during office hours by prior appointment.

8.

If no reply is received pursuant to this notice, the Corporation will be free to proceed further to terminate the said Agreement and to re-enter Borey 1/2

Without expressing any opinion, we observe that the petitioners may submit their reply, if not submitted so far, with MIDC - the Respondent Nos. 2 to 5. After following the necessary procedure the MIDC shall take final decision with respect to the subject matter of the show cause notice. The counsel appearing for the MIDC submits that so far the MIDC has not passed any final order consequent to the issuance of the show cause notice.

The learned counsel appearing on behalf of the MIDC to inform the said order to MIDC.
