By the impugned order, the learned Magistrate has rejected the application of petitioner to issue witness summons to the Manager, Bank of Maharashtra. The Magistrate has rejected the application observing that the accused will have to prove such facts during evidence. In my opinion, the writ petition can be disposed of by granting liberty to the petitioner to file such application once his evidence starts.

The writ petition is disposed of with liberty to the petitioner to file appropriate application for calling Branch Manager of the Bank of Maharashtra once his evidence starts. (AMIT BORKAR, J.)
