By this Civil Application, the applicant/insurance company seeks stay to the execution and implementation of the judgment and award dated 17th December, 2015 passed by the learned Chairman, Motor Accident Claims Tribunal, Mumbai in M.A.C.P. No. 1546 of 2009.

The learned Counsel for the applicant submitted that the applicant has deposited the entire decretal amount along with interest accrued thereon.

In view of the above, as the entire amount of compensation is deposited by the insurance company, the impugned judgment and award is stayed till the final disposal of the Appeal. 5.

Civil Application No. 3456 of 2016 is allowed and is accordingly disposed of.

FIRST APPEAL NO. 1238 OF 2016 6.

Issue notice to the respondent, returnable on 21st March, 2018. The appellant to furnish the copy of the appeal memo to the registry within one week.
