This is an Application under section 438 of Cr.P.C. filed by the aforesaid Applicant apprehending his arrest in C.R.No.359/2020 registered with South Akkalkot Police Station, Solapur Rural for offences punishable under sections 420, 504, 506 r/w. 34 of the Indian Penal Code.

Heard learned counsel for the Applicant and learned APP for the State. I have perused the records and considered the submissions advanced by the learned counsel for the respective parties. 3.

The aforesaid crime was registered pursuant to the FIR lodged by Chandralekha Vithoba Jadhav. It is alleged that the Applicant who was 1/2

Jayani 23 ABA1213.2021.doc acquainted with the Complainant and her mother, had got two sale deeds executed in the name of his son in respect of agricultural land which was owned by the Complainant. The sale deeds were registered on 16/08/2019. The complaint in respect of the same was filed on 26/07/2020.

This Court, by order dated 04/11/2020, had granted interim protection to the Applicant. The said interim relief is extended from time to time. Learned APP, under telephonic instructions from the Investigating Officer, states that the investigation is completed and the charge sheet has been filed. Presence of the Applicant is not required for the purpose of custodial interrogation.

Considering the above facts and circumstances, interim order dated 04/11/2020, stands confirmed.

Application stands disposed of.
