Heard learned Counsel for the parties. The Civil Application seeks interim relief on the ground that the application for allowing him to pay in installments the amount directed to be paid under Section 7A of the Employes' Provident Funds and Miscellaneous Provisions Act, 1952, has been pending before the Additional Central Provident Fund Commissioner (Maharashtra and Chattisgarh). On that basis, interim orders staying operation and implementation of the order for deposit were passed earlier. Now that the Applicant's application for installments is finally rejected by the authority, a substantive challenge Pg 1 of 2
caw1177-16.doc will have to be laid to that order. No relief can be granted in the Civil Application. The Civil Application is rejected. Learned Counsel for the Applicant seeks an order for extension of the interim relief. The application is refused.
