The parties and their Advocates are present before the Court. 2.
Clauses (ii), (iii), (iv) and (v) of the order dated 27th July, 2017, have been complied with by the parties. A gold ring which was in possession of the Applicant has been handed over to the Respondent. 3.
As set out in clause (viii) of the said order, the parties shall now appear before the Principal Judge, Family Court, Bandra, on 18th August, 2017, at 11.00 a.m. when the Learned Principal Judge, shall allow the parties to convert Marriage Petition No. A-14 of 2017 filed by the Respondent-husband seeking dissolution of his marriage with the Applicant-wife into a Petition for divorce by
KPPNair -2mutual consent and on the same day grant them divorce by mutual consent. 4.
The Applicant undertakes that upon the decree of divorce by mutual consent being passed on 18th August, 2017, she shall on or before 28th August, 2017, withdraw Criminal Application No. 130 of 2017 filed in the Court of Judicial Magistrate, First Class, Shahada, under Section 12 of the Protection of Women from Domestic Violence Act, 2005. The undertaking is accepted. 5.
All concerned including the Family Court, Bandra, Mumbai, as well as the Judicial Magistrate, First Class, Shahada, shall act on an ordinary copy of this order duly authenticated by the Personal Assistant of this Court. 6.
In view of this order, the above Misc. Civil Application stands disposed off.
