Having heard learned Advocates for respective parties and in view of fact that Inquiry No.23 of 2022, pending before learned Joint Charity Commissioner, Pune Region, Pune is at the stage of evidence, this Court is not inclined to enter into merits of rival submissions. 2.

Next date before learned Joint Charity Commissioner is on 24th November 2023. On that date, Shiv

2/2 39.fa630.23.doc Respondents undertake to file evidence afÏdavit and appellant shall conduct their cross examination. 3.

It is noted that that Respondents have filed purshis dated 17th August 2023, thereby withdrawing the prayer to declare sale deed dated 6th April 2022 as illegal and to set it aside.

Interim relief granted by Joint Charity Commissioner, Pune Region, Pune dated 30th January 2023, in clause (2) of the operative order shall not come in way of appellants while incurring out day-to-day expenditure of hospital.

Learned Joint Charity Commissioner shall decide Inquiry No.23 of 2022, within a period of three months from the date of receipt of this order, for which parties shall cooperate.

First Appeal as well as Interim Application disposed of in the aforesaid terms.
