P.C.

1] The application is filed for bail. Both sides are heard. Papers of investigation are made available to this Court. The charge sheet is filed. The offence is under section 354(d), 376(i)of Indian Penal Code and under Sections 4, 8 and 12 of Protection of Children from Sexual Offences Act, 2012 vide C.R.No.31 of 2017 with Mohol Police Station, Dist. YBG 46-ba-1124-17 mobile hand set etc. When the prosecutrix expressed that the applicant was married man and he should not do these things the applicant persisted and ultimately the prosecutrix became victim. Perused the material on record. The medical evidence is consistent. The allegations made against the applicant in the statement made under section 164 of Cr.P.C. supports the case. In these circumstances there is clear possibility that the present applicant will tamper with the prosecution witness considering her mental state. This court is, therefore, not desirous of releasing the applicant on bail. The application is rejected. Trial court shall expedite the trial and try and dispose of the same within a period of six months from today.
