Heard the Learned Advocates appearing for the parties. Following order is passed, by consent :- (a) The Order passed by the Presiding Officer, Industrial Court, Pune in Reference (IT) No. 27 of 2015, dated 12 th April, 2017 is set aside.

(b) The Presiding Officer, Industrial Court, Pune shall hear the Reference (IT) No. 27 of 2015 afresh and decide the same within a period of sixteen weeks from the date of this order. The Presiding Officer, Industrial Court, Pune shall hear the Reference (IT) No.27 of 2017 on day-to-day basis. (c) The Respondent agrees that they shall not apply for any adinterim/interim reliefs in the Reference (IT) No. 27 of 2015 but shall proceed with the hearing of the Reference as directed by this Court.

kpd 2 / 2 929-WP-9830-2017.sxw (d) The parties and/or their Advocates shall appear before the Presiding Officer, Industrial Court, Pune on 11 th December, 2017 at 11.00 a.m. and obtain necessary directions in the matter.

(e) The Reference (IT) No. 27 of 2015 shall be decided without being influenced by any of the observations made in the impugned order. (f) The parties shall not seek any adjournment unless absolutely necessary. The Presiding Officer, Industrial Court, Pune shall also not adjourn the proceedings unless absolutely necessary.

(g) All contentions of the parties are kept open. 2.
