1] By an Order dated 5th May 2017, the applicant was granted interim relief.

2] Perused the record of investigation.

The record clearly indicates that, the applicant is the husband of the first informant and he has already filed an application for restitution of conjugal rights which is sub-judice before the Family Court, Mumbai. After perusing the record of investigation, this Court is of the view that the custodial interrogation of the applicant for further investigation of the present crime is not necessary.

It is the condition precedent for confirmation of interim relief that, the applicant, directly or indirectly shall not contact and/or influence the witnesses in the present crime.
