By this petition, the petitioners seeks quashing of the FIR bearing C.R. No.I-264 of 2018 registered with the Kalyan Taluka Police Station, Thane Rural, at the behest of the respondent No.2, for the alleged offences punishable under Sections 447, 420, 465, 467, 468, 471 r/w 34 of the Indian Penal Code.

Learned APP submits that the police after investigation have filed a 'C' Summary Report, in the said case in the Court of the learned Judicial Magistrate First Class at Kalyan on 13th July 2022. Learned APP has tendered a copy of the report of the concerned PSIVishwas Walke, Kalyan Taluka Police Station, Thane Rural, dated 5th December 2022, evidencing the same. The same is taken on record. 3.

Considering the aforesaid report and the submissions advanced by the learned APP, learned counsel for the petitioners does not press this petition and seeks leave to withdraw the same, with liberty to file an appropriate application/petition, if the occasion so arises, in future.

Petition is accordingly disposed of as withdrawn with liberty as prayed.

We make it clear, that we have not heard the aforesaid petition on merits and as such all contentions of all parties on merits are kept open.
