Learned counsel for parties agree that the issues arising in this appeal and the cross-objection therein stand covered by the common judgment and order dated 27th August, 2015 in First Appeal No.112 of 2009 and connected matters.

The Division Bench of this Court has fixed the market value at Rs.1380 per square meter. This is the rate which will apply to the lands covered in the present appeal and cross-objection as well. The appeal instituted by the State will stand dismissed and the crossobjection will stand allowed by re-fixing the market rate at the rate of Pg 1 of 2

p.4.fa.482.2015.doc Rs.1380 per square meter. Besides the respondents-claimants will also be entitled to proportionate increase in statutory benefits. The payments to be made as per the directions in paragraph 14 of the common judgment and order dated 27th August, 2015. The appeal and cross-objection stand disposed of in the aforesaid directions. Civil Application No.208 of 2016 seeking extension of time to file cross-objection is also allowed. Civil Application No.2646 of 2016 seeking withdrawal of compensation amount deposited before the Reference Court is also substantially allowed.
