Mr. Sutar, learned Counsel for the Petitioner, having taken instructions from his client, seeks leave to withdraw the petition with liberty to make representation to the Secretary, Urban Development Department, Maharashtra State in respect of the grievance raised in the writ petition. Leave with liberty as prayed for is granted. Petition is allowed to be withdrawn and is dismissed as such. 2.
It is made clear that this Court has not gone into merits of the matter and all points and contentions of the respective parties are kept open.

In the event, Petitioner files such representation within four weeks from today, the Secretary shall decide the same expeditiously and only after giving an opportunity of hearing to all concerned.
