P.C. :- After arguing the matter for some time, the learned Counsel for the Appellant on instructions seeks leave to withdraw the Appeal. The Appeal is dismissed as withdrawn. 2.

The learned Counsel submits that the Suit be expedited considering the Appellant is belonging to the backward class community and is financially not well-off.

Liberty to the Appellant to make appropriate request to the City Civil Court, who will consider the same sympathetically, no doubt keeping in mind the earlier time bound commitments. (N.M. JAMDAR, J.)
