Heard the learned Counsel for the Applicant.

The first informant has filed an Application seeking intervention in the above Application. The learned Counsel for the Applicant submits that the Applicant has no objection if the Intervener is allowed to be joined as party Respondent No.2. The Interim Application stands allowed.

The Applicant shall amend the Application and implead SSP 1/3

the first informant as party Respondent No.2. 4.

Issue notice to the Respondents, returnable on 7th June, 2022.

The learned APP waives service on Respondent No.1 and the learned Counsel for Respondent No.2 waives service on Respondent No.2.

Learned Counsel for Respondent No.2 seeks time to file an AfÏdavit in Reply 7.

Perused the allegations in the FIR. The genesis of the transaction appears to be in an investment agreement executed between the Applicant and Ms. Geeta Waswani and Mr. Sunil Ramchandani, the alleged victims. It further appears that pursuant to the investment agreement, documents in the nature of deed of reconstitution of the Partnership firm, were executed and a new company i.e. Vita Wise Pharma Pvt. Ltd., came to be incorporated with the alleged victims as share holders of the Company. 8.

The matter warrants consideration.

Let the Respondent No.2 file an AfÏdavit in Reply within a period of two weeks.

List on 7th June, 2022.

In the meanwhile, no coercive action be taken against SSP 2/3

the Applicant in C.R.No.102 of 2022 registered with Khar Police Station.
