Heard Mr. Datar, learned Counsel for petitioner and Mr. Oak, learned Counsel for respondent at length. 2.

By this Petition under Section 11(6) read with 15(2) of the Arbitration and Conciliation Act, 1996 (for short 'Act'), petitioner has prayed for constitution of Arbitral Tribunal for adjudication of disputes between the petitioner and respondent in terms of Clause 48 of the Development Agreement dated 28.11.2005. Mr. Datar submitted that petitioner has nominated Mr. S. A Dwivedi, Retired District Judge as the nominee of the petitioner. Mr. Oak states respondent has nominated Advocate U. A. Patel as the nominee of the respondent.
