Learned Counsel for the applicant states that the applicant - Rasheed Abdultyeb Maskati has expired. The learned Counsel submits that his death certificate is filed before the learned Metropolitan Magistrate, 41st Court, Shindewadi, Dadar, Mumbai. Pursuant to that, the learned Metropolitan Magistrate has passed the order on 22.11.2017 that the case is abated against the accused. A copy of the said order below exhibit 1 is produced, taken on record and marked exhibit 1 for identification.
