This Application is for condonation of 56 days delay in preferring the appeal challenging the judgment and award dated 05.09.2013 passed by the Civil Judge, Senior Division, Alibaug at Raigad in LAR No.819/2000 (Old No.27/1991), Though Adv. Mr. Nilesh Masurkar has filed Vakalatnama on behalf of the Respondent, none appeared for them.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

a) The Civil Application is allowed in terms of prayer clause (b) which reds thus:

"(b) this Hon'ble Court be pleased to condone the delay of 56 days in filing the above mentioned First Appeal against the judgment and award dated 05.09.2013 passed by the learned Civil Judge, Senior Division, Alibaug-Raigad in LAR No.819/2000 (Old LAR No.27/1991.)"

b) Civil application stands disposed off accordingly.

c) No order as to costs.
