At the outset, the learned APP submits that in the present case, sessions trial has commenced. The first informant as well as two witnesses have been examined. The matter is posted on 3rd August 2018 for recording of further evidence.

Since the trial has commenced, this Court is not inclined to consider the application under Section 439 of the Code of Criminal Procedure. However, the learned Sessions Court, Solapur is requested to expedite the trial. The learned Sessions Court, Solapur shall make every endeavour to conclude recording of evidence as far as possible by 31st December 2018.
