This Application is moved for pre-arrest bail, as these applicants/accused apprehend arrest in C.R. No. 11 of 2015 registered by Vadgaon Police Station for the offences punishable under sections 3(1), 4, 5, 6, 7 of Prevention of Immoral Trafficking Act, 1956. One Police Constable Mr. Anant Rajaram Desai has given information that the applicants are carrying the business of immoral trafficking of women at lodge, based on which the Hotel, namely, Vanshree Executive Lodging and Boarding was raided on 18th April, 2015 by the police. They found two victims aged 20 and 24 years residing at West Bengal who were used for trafficking.

11.ABA698_2015.doc the applicant no. 1 Vijay Gaikwad has taken this hotel for lease and applicant no. 2 Vijay Nalawade is the Manager of the Hotel. Both are resident of Sangli. The hotel is at Vathar, Dist. Kolhapur. The applicants are not concerned with any illegal activity taken place in the hotel. 3.

Learned APP opposed the Application. He relied on the remand report dated 19th April, 2015 so also the report which was submitted by the police before the learned Sessions Judge. The learned APP submitted that the offence is serious and their custody is required. He further pointed out that Kiran Kadam, who was the staff of the hotel was arrested and he got regular bail.

Perused the FIR, remand report and the order passed by the learned Sessions Judge, Kolhapur. Considering the nature of the offence, I am of the view that custody of these two applicants are required to find out the details in respect of the offence. Hence, the Application for anticipatory bail is rejected.
