Rule. The respondents waive service. Since a short point is involved and the pleadings are complete, with the consent of both sides, we dispose of this writ petition finally by this Judgment and Order.

The facts and the issue involved in this petition being identical to the facts and the issue involved in Civil Writ Petition No.14375 of 2016, allowed in terms of prayer clauses (a) and (c) today by this Court by a separate detailed Oral Judgment,
this petition, too, deserves to be allowed in terms of the said Judgment. Rule in this petition is accordingly made absolute in terms of prayer clauses (a) and (b). There shall be no order as to costs.
