The Learned Counsel for the parties Mr. Mahajani for the Petitioner and Mr. Nikam for the Respondent No.3 had tendered the consent terms which have been taken on record on 5-7-2016. However, the hearing of the Petition has been deferred to see to it that the compliances are made by the parties. Accordingly the Petition has been placed before this court today. The Learned Counsel appearing for the Petitioner states that in terms of clause 2(b) of the consent terms a cheque for Rs.63,000/- has already been handed over to the Respondent No.3 workman by registered post immediately after the consent terms were filed. The said fact is not disputed by the Learned Counsel for the Respondent. The Learned Counsel for the Petitioner states that balance remaining of Rs. 62,000/- is ready with him and would be despatched to the Respondent immediately. The Learned Counsel for mmj

wp-6844-16-(25) the Respondent No.3 states that the formalities relating to the provident fund are not yet completed. To this the Learned Counsel for the Petitioner states that it is for the Respondent No.3 to complete the formalities by giving a cancelled cheque to the provident fund authorities so that the formalities would be completed. The Learned Counsel for the Respondent No.3 states that the Respondent No.3 would co-operate in that regard. It is expected of the parties that they would complete the formalities in terms of the consent terms expeditiously. The Learned Counsel appearing for the Respondent No.3 states that on receiving payment in terms of clause 2(b) the Respondent No.3 would withdraw the Contempt Petition. Statement accepted.
