The applicant came to be arrested in Crime No. 41 of 2022 registered at Paud Police Station, Pune (Rural) for the offences punishable under Sections 376, 376 (2)(n), 504, 506, 507 of the Indian Penal Code and Sections 3,4 of the Protection of Children from Sexual Offences Act. 3.

I have heard the learned counsel for the applicant, the learned APP for the respondent-State, and the learned counsel for the Respondent No. 2.

According to the prosecution, the present applicant on several occasions committed sexual intercourse with the victim on the pretext that he would be marrying her, though he was aware that she is minor. 5.

I have perused the statement of victim recorded under Section 164 of Cr.P.C. According to her, she had love affair with the applicant. Her family members were against their love affair and thus they had lodged the report. She has stated that the present applicant had not committed any sexual intercourse with her. Considering the overall facts and circumstances, I am inclined to release the applicant on bail. Hence, the following order is passed:

(i) Application is allowed.

(ii) The applicant shall be released on bail in Crime No. 41 of 2022 registered at Paud Police Station, Pune (Rural) for the offences punishable under Sections 376, 376 (2)(n), 504, 506, 507 of the Indian Penal Code and Sections 3,4 of the Protection of Children from Sexual Offences Act on furnishing PR bond in the sum of Rs. 15,000/- with one surety in the like amount.
