Learned APP on instructions of the Investigating Officer, who is present in the Court today, states that the charge-sheet in the said case has been filed today.

In view of the statement made by learned APP, on instructions, the learned counsel for the applicant does not press this application and seeks leave to withdraw the same with liberty to file an application, after filing of the charge-sheet, before the appropriate Court. 3.
Application is accordingly disposed of as withdrawn with liberty as prayed.

It is made clear, that if an application is filed, after filing of the charge sheet, the same shall be decided by the learned Judge, on its own merits, uninfluenced by the withdrawal of this application.

In view of the aforesaid, the Intervention Application being Criminal Application No.524 of 2017 does not survive and the same is also disposed of.
