The order made by this Court on 13 August 2014 below Civil Application No. 1893 of 2014 indeed, grants the petitioner liberty to raise contention with regard to the status of Sunderji Mulji Shah as a partner of defendant partnership firm. However, on the basis of the same, it is not open to the petitioner to insist that the petitioner's application below Exhibit-34, which has since been dismissed, should be reheard or order made thereon reviewed at this stage. 3] At the stage of final hearing, however, in terms of liberty granted by this Court, all contentions of the petitioner with regard to the status of Mr. Sunderji M. Shah shall have to be considered. 4] Accordingly, there is no reason to interfere with the impugned order and this petition is accordingly dismissed. (M. S. SONAK, J.) dinesh 1/1
