Heard learned Counsel for the parties. Perused the Application and reply filed by the Respondent. 2.

This is an Application for condonation of delay in filing the above First Appeal. Learned Counsel for the Applicants invited the Court's attention to explanation given in paragraph nos 2 and 3 of the Application and submitted that sufficient cause is made out. He submitted that the nominal delay is caused due to procedural requirements of approval etc.

Learned Counsel for the Respondent strenuously opposed and invited this Court's attention to the reply filed by the Shubham Talle

1-CAF-371-2015.doc Respondent/Company. It is contended that there is no sufficient explanation and vague statements are made which are devoid of particulars. It is submitted that the delay is not properly explained. 4.

According to office note there is an delay of 67 days. Considering the extent of delay and facts and circumstances narrated in the Application, sufficient cause is made out. The above Civil Application is allowed in terms of prayer clause (a). The delay is condoned. First Appeal be numbered.
