There is delay in filing the civil application. Mr.Lokeshappa, learned counsel appearing for the applicant states that compilation of documents, pleadings and evidence forming part of the record before the Tribunal shall be filed within two weeks from today. Statement is accepted. The applicant is permitted to file compilation of documents, pleadings and evidence forming part of the record before the Tribunal in place of private paper book with a copy to be served upon the other side simultaneously. Delay in filing the civil application is sufficiently explained in paragraphs 4 to 6 of the civil application.

Civil Application is made absolute in terms of prayer clause (a). Insofar as prayer clause (b) is concerned, the applicant is 1/2

The order dated 28th January, 2009 is recalled on the aforesaid conditions. The civil application is disposed off on the aforesaid terms. The applicant is directed to pay cost of Rs.3,000/- to the respondent's advocate within two weeks from today as a condition precedent for the aforesaid order.
