The learned counsel for the Petitioner filed praecipe for fixing an early date of hearing. He submits that by this Writ Petition, they are challenging the order dated 02.02.2018 passed by the court below allowing the Application made by the Respondent - Defendant for carrying out amendment in the counter claim.

Considering the submissions made by the learned counsel for the Petitioner and as the impugned order is of February 2018, following order is passed:

a The petitioner is directed to remove all office objections on or before 08.03.2019, failing which the writ petition shall stand dismissed without further reference to the court. Basavraj G. Patil 1/2

The Petitioner is permitted to serve the Respondent along with entire proceedings by way of private notice either by RPAD and/or by hand delivery and to file an Affidavit of service to that effect on or before 29.03.2019.

If Affidavit of service is filed within stipulated time as stated hereinabove, office is directed to place the matter on board on 03.05.2019, else, as per CMIS date.
