By this Civil Application, applicant is seeking condonation of 53 days delay in filing Firs Appeal challenging the judgment and award dated 18.12.2013 passed by Employees Insurance Court, Thane in Application (ESI) No.2 of 2011.

Considering the submissions made by learned Counsel for the applicant, averments made in Civil Application, I am satisfied that the applicant has made out case for allowing this Civil Application. Hence, following order :- a) Civil Application is allowed in terms of prayer clause (a), which reads thus :- "a) That the delay of 53 days in filing the memo of appeal may please be condoned and that the appeal be taken on record and ordered to be numbered."

b) Civil Application stands disposed of accordingly.

c) No order as to costs.
