Heard the learned counsel appearing for the parties.

The petitioner was absent and, therefore, a nonbailable warrant had been issued against him. I have gone through the medical report. There does not appear to be anything serious which may prevent the petitioner to appear before the trial court. In this situation, the only limited relief which I am inclined to give to the petitioner is to cancel his Borey 1/2

spb/ 9wp2010-15.sxw warrant. I am not inclined to grant him permanent exemption from personal appearance.

Non-bailable warrant issued against the petitioner shall stand cancelled. Prayer for exemption is rejected. The petitioner shall appear before the trial court on the next date of hearing.

This criminal writ petition stands disposed of. (JUDGE) .....
