This civil application is preferred by Insurance Company for condonation of 168 days delay in filing First Appeal challenging the Judgment and Award dated 05.08.2013 passed by the Motor Accident Claims Tribunal, Thane in M.A.C.P. No. 59 of 2008.

25caf 882-15=.doc counsel for the applicant and averments made in civil application, I am satisfied that applicant has made out the case for allowing the civil application. Hence, civil application is allowed in terms of prayer clause (a), which reads thus:

"a) that the delay caused in filing the present First Appeal be kindly condoned and the accompanying First Appeal be registered and heard for admission."

Civil Application stands disposed of accordingly.
