Heard learned Counsel appearing for respective parties. This petition is filed for transfer of investigation into F.I.R. No.317 of 2013 lodged by the petitioner on 24.07.2013 with Borivali Police Station for the offence punishable under Sections 342, 506 (2), 386, 388 r/w 34 of the IPC.

Mr. Yagnik, learned APP placed on record letter dated 28.01.2015 written by the Senior Inspector of Police, Borivali Police Uday S. Jagtap

2003-14-wp=.doc Station, Mumbai to the Public Prosecutor, with reference to the aforesaid F.I.R. The letter discloses that after completion of the investigation into the said FIR, the police have filed charge-sheet under Sections 342, 506 (2), 386, 388 r/w 34 of the IPC before the 26th Metropolitan Magistrate Court, Borivali, Mumbai on 16.01.2015 being C.C. No. 163/P/2015.
