The petition is filed seeking direction to the respondents to transfer the investigation in the FIR bearing CR No. I-09/2016 from Kharghar Police Station to any other investigating agency. By amendment, the petitioner has also asked for further investigation in the above FIR through an impartial and independent investigating agency. 3.

Ms. Shinde, learned APP stated that the investigation is completed and charge-sheet is also filed against six accused for offences Shubhada S Kadam 1/2

33 wp 1785.16.doc punishable under Section 306 read with Section 34 of the Indian Penal Code, 1860.

Since the investigation is already completed, prayer for transfer is not maintainable. The petitioner, however, is always at liberty to approach the trial Court for an appropriate remedy. 5.
