This is an application under Section 438 of Code of Criminal Procedure for anticipatory bail.

The applicant is apprehending his arrest in Crime No.237 of 2023 registered at Chaturshringi Police Station, Pune for the ofence punishable under Section 381 of the Indian Penal Code. 3.

I have heard the learned counsel appearing for the applicant and the learned APP for the respondent / State. 4.

The allegations are of theft of articles worth Rs.20,000/- from the shop of the complainant. The allegations of theft, however, are against the co-accused Salman, who was working in the shop of the complainant. The allegations against the applicant are that the complainant had allowed to work the said co-accused in his shop on the recommendation of the present applicant. Dinesh S. Sherla 1/2

Considering the nature of allegations against the applicant and as there are no other criminal antecedents, I am inclined to release the applicant on anticipatory bail. In the result the following order is passed.

ORDER

A) The Application is allowed.

B) In the event of arrest of the applicant in C.R. No. 237 of 2023 registered at Chaturshringi Police Station, Pune for the ofence punishable under Section 381 of the Indian Penal Code, he be released on bail on executing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.

C) The applicant shall attend the concerned police station as and when called by the Investigating Ofcer and shall cooperate in the investigation.
