(VACATION COURT) P.C.:
1) Heard. Prayer for permission to travel is opposed by Mr. Joshi, counsel for Respondent no. 2 in the background of pendency of present proceedings. According to him, progress in the proceedings will hamper in case if the Applicant's prayer is granted. 1/3
2) We have considered said submissions in the backdrop of observations made by this Court in the order dated 06/04/2022 wherein Applicant was permitted to process his prayer for grant of Visa.
3) We have also perused the document issued by employer of the Applicant viz. Infosys offering him overseas employment and the terms and conditions of such employment. In that view of the matter, case for grant of relief in terms of prayer clause (a) is made out. 4) Application stands allowed in terms of prayer clause (a) which reads thus:
"(a) This Hon'ble Court be pleased to permit the Applicant to travel United State of America at Denver on such terms and conditions as this Hon'ble deem fit". 5) The grant of Application is subject to following conditions: (A) Applicant shall furnish an undertaking to the Court below that as and when required, he shall physically attend the proceedings as and when so required.
(B) Applicant shall cooperate with the Court below in pending proceedings, if required by connecting himself through virtual 2/3
mode thereby avoiding any delay in the said proceedings. 6) It is further directed as jointly prayed by respective counsel that the Principal District Judge, Pune shall appoint a trained Mediator to mediate inter-se between the parties so as to have an amicable settlement.
