This petition challenges the order dtd. 26th April, 2016 passed by the Additional Collector, Pune on Dispute Application No.14 of 2016. By that order, while granting leave to the petitioners to file their written statement, the proceedings have been reserved for orders. This would mean that after filing of the written statement, there would be no opportunity of hearing to the either side on the application. In that circumstance, Mr. Nikam, the
Dusane 2/2 wp5641.2016 learned advocate for respondents no. 3 to 5 makes a statement that he has no objection if the written statement filed by the petitioner is taken on file and opportunity of the hearing is granted to both the sides.
In view of the statement, the petition is disposed off by consent. Part of the impugned order, reserving the dispute for orders is set aside. The Additional Collector, Pune shall take the written statement of the petitioners on record and hear both the parties on Dispute Application No.14 of 2016 and decide the same within a period of six weeks from today.
