Heard Ms. Chaitrali Deshmukh for respondent no.2 and learned APP Ms. Malhotra for the sate.

The learned APP was asked to produce on record the final cause of death, which she has placed on record, wherein the cause is reflected as "Coronary Artery atherosclerotic heart disease with old myocardial infarction".

Considering that the applicant had no knowledge about the ailment of the deceased. It is alleged that he was manhandled by applicant, the applicant deserve protection from arrest. 4.

This court would like to place an appreciation on Ms. Chaitrali Deshmukh, who has effected the assistance to the court. The legal Ashish Mhaske

2/2 11 ABA 1348.22.doc Services Authority, shall ensure that the legal remuneration is due and payable to her, shall be made over to her within a period of 4 weeks from today.

Needless to state that the applicant shall render his cooperation in the investigation.

:ORDER:

(a) Application is allowed.

(b) In the event of arrest, applicant Viquar Husain Imtiyaz Husain @ Munna - shall be released on bail in connection with C.R.No. 0300 of 2022 registered with Mumbra Police Station on furnishing P.R. Bond to the extent of Rs.25,000/- with one or two sureties in the like amount.

(c) The applicant shall report to the concerned police station on 3/10/2022 and 4/10/2022 and thereafter as and when called for.

(d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer and shall not tamper with evidence.
