Learned Counsel for the Petitioner admits that before filing of the present Petition, the Petitioner has filed an appeal, which is pending adjudication before the Commissioner of Income Tax (Appeals). In that view of the matter, we are not inclined to entertain the present Petition. Accordingly, the Petition is disposed of. We, however, direct the Commissioner of Income Tax (Appeals) to consider and dispose of the appeal of the Petitioner herein, pending before it, as expeditiously as possible.
