The Applicant was initially convicted by the Trial Court for an offence under Section 354 of the Indian Penal Code and was directed to undergo the imprisonment for a period of nine months. The appellate Court by its judgment and order dated 28th April, 2015 has altered the charge from Section 354 to Section 352 of the Indian Penal Code and has sentenced the Applicant for a period of three months of rigorous imprisonment. Taking into consideration the fact that the Applicant has been convicted for the offence punishable under Section 352 and has been directed to suffer rigorous imprisonment of three months, I am inclined to release the Applicant on bail by suspending the sentence.
The Applicant be released on bail by furnishing a PR Bond of Rs.25,000/- with one solvent surety in the like amount. (A.S. Gadkari, J.)
