Heard the Learned Advocates appearing for the parties. Following order is passed, by consent.

(a) The Judgment and Order dated 9 th March, 2017 passed by the District Judge-11, Thane is set aside.

(b) The District Judge-11, Thane shall hear the Civil Appeal No.190 of 2013 afresh and dispose off the same by his Judgment within a period of four weeks from 28th August, 2017.

(c) The parties have agreed that they shall not be leading any further evidence.

(d) All contentions of the parties are kept open. (e) The parties shall appear before the District Judge-11, Thane by themselves and/or through their Advocates on 28.08.2017 at 11.00 a.m. and obtain

(f) The Learned District Judge-11, Thane shall if necessary hear the matter on day-to-day basis and shall not grant any adjournment/s to either party unless absolutely necessary.

(g) All concerned to act on an ordinary copy of this order duly authenticated by the Personal Assistant of this Court.

The above Second Appeal as well as Civil Application accordingly stand disposed off.
