At the outset, learned APP makes a statement, that the trial has commenced and till date 10 witnesses have been examined in the present case. She states that about 7 to 8 more witnesses are to be examined. Statement accepted.

In view of the statement made by learned APP, the learned counsel for the applicant does not press this application and seeks leave to withdraw the same. He submits that the Court, which was conducting the trial is vacant and that the applicant's case is not assigned to any other

2/2 19-ba.1321.2019.doc Court. He further submits that the applicant will file an appropriate application before the Principal Judge seeking transfer of his case to another Court.

Accordingly, if an application, for transfer of the applicant's case is filed, the learned Principal Judge to pass appropriate orders on the said application, since the trial of the applicant is made time bound by an earlier order passed in co-accused bail application. 4.

The Application is accordingly disposed of with the aforesaid direction.
