Parties request that if the appeal before the learned District Judge, Thane, is heard and decided finally, within three months, they need not press this appeal and till then, the respondents shall not construct beyond three floors and this construction or completion of the third floor will be subject to the appellate proceedings. Learned Senior Counsel expresses agreement to this interim arrangement.

In view of these statements, this appeal is disposed of with a direction to the learned District Judge, Thane to endeavour to hear and decide the appeal on or before 15.3.2016.
