The learned counsel for the applicant, on instructions, seeks leave to withdraw the bail application with liberty to approach the Trial Court as according to the learned counsel for the applicant there are material change in circumstances, after the rejection of the previous bail applications. The bail application is accordingly disposed of as withdrawn with liberty as prayed. It is made clear that in the event the applicant approaches the learned Sessions Judge, the learned Sessions Judge shall examine whether there is any material change in circumstances, after rejection of the previous bail applications and shall then decide the same in accordance with law.
