This is an application under Section 438 Cr.P.C. filed by the aforesaid Applicant apprehending his arrest in Crime No.81 of 2023 registered with Cuffe Parade Police Station for offences under Section 323, 324, 504, 506(2) r/w. 34 of the Indian Penal Code. 2.

Heard learned Counsel for the Applicant and learned APP for the State. I have perused the records and considered the submissions advanced by the learned Counsel for the respective parties . 3.

The aforesaid crime was registered pursuant to the FIR lodged by Sureshkumar Bholanath Gupta. A perusal of the FIR prima facie reveals that on 2.4.2023 at about 3.30 p.m. the co-accused inflicted Digitally signed by PRASANNA P SALGAONKAR Date:

2023.05.06 10:56:07 +0530 injuries on the first informant by knife. It is stated that the Applicant PRASANNA P SALGAONKAR

also came to the place of the incident, and he also assaulted and abused him and threatened to cause his death.

The records reveal that four other crimes are registered against the Applicant for similar offences viz,. 324, 326, 506, 354A etc. Learned Counsel for the Applicant makes a statement that the Applicant will not enter within the jurisdiction of Cuffe Parade and Colaba Police Station till filing of the chargesheet. In view of the said statement, and considering the nature of the accusations leveled against the Applicant, the application is allowed on the following terms and conditions:- (i) In the event of arrest of the Applicant in Crime No. 81 of 2023 registered with Cuffe Parade Police Station, the Applicant be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twentyfive Thousand Only) with one or two sureties in the like amount; (ii) The Applicant shall report to the Investigating Officer for two days on 8th and 9th May, 2023 between 11.am. to 2.00 p.m.; (iii) The Applicant shall not enter the jurisdiction of Cuffe Parade and Colaba Police Station from 10th May, 2023 onwards till filing of the chargesheet.

(iv) The Applicant shall keep the Investigating Officer informed of his

current address and mobile/contact details, and/or change of residence or mobile/contact details from time to time.

(v) The Applicant shall not interfere with the Complainant and the other witnesses, or tamper with the evidence in any manner. .

Application stands disposed of.
