The learned counsel appearing for respondent No. 2 submitted that respondent No. 2 Navnit Parekh expired on 21st January, 2016 and he has communicated this fact to the appellant on 14th September, 2016.

The record discloses that till today, the learned counsel for the appellant has not taken steps. Hence, Appeal and Civil Applications abates against respondent No. 2-Navnit Parekh. As per affidavit of service, respondent No. 1 Swati Joshi is served. None present for respondent No. 1. Civil Application is allowed in terms of prayer clauses 10(a), (b) and (c). The learned counsel for the appellant to take note that Appeal is old and hence should take immediate steps. 3.
