Heard learned Counsel for the parties.

The impugned order is an interim order passed by the Industrial Court, Mumbai, on the basis of settlements between first PetitionerCorporation and its recognized Union, who is Respondent to the present Petition. It is agreed between learned Counsel for the parties that the Petition can be disposed of without indicating any reasons in the order. Accordingly, the Petition is disposed of in terms of the following order. : O R D E R :

(i) The impugned interim order of the Industrial Court is substituted by directing the first Petitioner-

WP 6606-16.doc Corporation to disburse to the Respondent-Union 50% amount collected from 58,169 member-employees of the Respondent-Union, who have consented to the deduction of Annual Subscription Fees from their salaries to be paid to the Respondent-Union. Such disbursement shall be made within a period of two weeks from today;

(ii) The Industrial Court, Mumbai, is directed to dispose of Complaint (ULP) No.1 of 2016 as expeditiously as possible, and in any event, within a period of four months from today;

(iii) The balance 50% amount collected shall be kept by the first Petitioner-Corporation in a bank of its choice in Fixed Deposit/s. Such deposit/s shall abide by final orders that may be passed by the Industrial Court in Complaint (ULP) No.1 of 2016.

(iv) The Petition is disposed of accordingly.
