This is an Application under section 438 of Cr.P.C. for pre-arrest bail in C.R.No.422/2020 registered with Lonavala City Police Station, Dist. Pune Rural for offences punishable under sections 406, 417, 420, 504, 506 of the Indian Penal Code.

Heard learned counsel for the Applicant and learned APP for the State. I have perused the records and considered the submissions advanced by the learned counsel for the respective parties. 3.

The aforesaid crime was registered pursuant to the First Information Report (FIR) lodged by the victim. For the reasons recorded in detail in order dated 22/03/2021, this Court had granted 1/3

interim protection to the Applicant. The said interim protection has been extended from time to time. Though the custody of the Applicant was sought for recovery of the ornaments, till date, the prosecution has not been able to make any recovery from the Applicant though the Application has been pending since November, 2020. 4.

Considering the said fact as well as the reasons stated in the order dated 22/03/2021, interim protection granted by this Court stands confirmed. Hence, the Application is allowed on the following terms and conditions :- (a) In the event of arrest of the Applicant in C.R.No.422/2020 registered with Lonavala City Police Station, Dist. Pune Rural, he shall be released on bail, on furnishing P.R. bonds in the sum of Rs.30,000/- with one or two sureties in the like amount ;

(b) The Applicant shall report to the Investigating Officer as and when required ;

(c) The Applicant shall not interfere with the complainant and the other prosecution witnesses and shall not tamper with 2/3

the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case in any manner ;

(d) The Applicant shall keep the Investigating Officer informed of his current address and mobile contact numbers, and/or change of residence or mobile details, if any, from time to time.
