After the matters are heard at some length, it is agreed between learned Counsel on instructions of their respective clients that the impugned order dated 22 February 2017 may be quashed and set aside and the civil appeals be remanded to the District Court at Pune for a fresh hearing in accordance with law. Learned Counsel for Respondent No.1-bank places a copy of an e-mail print out reflecting the instructions on behalf of his client on record. The copy is kept on record and marked 'X' for identification. The District Court at Pune is requested to dispose of the matters as expeditiously as possible and preferably within a period of six months from today.
The Appeals from Order are disposed of accordingly. In view of the disposal of the Appeals from Order, the Civil Applications do not survive and the same are disposed of. (S.C. GUPTE, J.)
