The above Civil Application has been filed seeking condonation of delay of 54 days in filing the First Appeal. The reasons therefor are mentioned in the Civil Application. The Learned Counsel appearing for the Respondent No.1 and the Learned Counsel appearing for the Respondent No.2 oppose the application, but ultimately leave it to this Court. Having regard to the fact that the claimants have filed the above First Appeal for enhancement as also having regard to the reasons mentioned in the Civil Application, case for exercise of discretion is made BGP.
(14)-CAF-88-15.doc out. The Civil Application is accordingly allowed. Resultantly, the delay of 54 days in filing the First Appeal stands condoned. The Civil Application is accordingly disposed of.
