After hearing both sides, the parties have decided to settle the matter relating to grant of T.D.R. to the petitioners of the 1/3
lands developed and handed over to Corporation as per the Development Control Rules. Accordingly they have filed consent terms stated to be 'Minutes of Order' signed by the petitioners and on behalf of respondents No. 2 and 3 by the Commissioner of Municipal Corporation. It is also counter signed by the respective advocates of parties. The minutes of order is taken on record and marked as "X" for identification. The Resolution passed by the Standing Committee is also taken on record and marked as "Y" for identification.
The statement is made by the learned counsel appearing for the parties that there is no issue with regard to the signature and authorization and no third party will be affected by this and the settlement in the form of Consent Terms / Minutes of Order is made within the frame work of law and the record. In view of this, the present writ petition is disposed of in terms of 'Minutes of Order'.
A statement is made by the learned counsel appearing for respondents No. 2 and 3, on instructions, that no demolition will take place pending decision on the application for regularization of 2/3
structure in question filed by petitioners.
The petition is disposed of accordingly. No order as to costs.
In view of the disposal of main petition, all civil applications are also disposed of.
